Probate And Estate Administration

Dealing with a loved one’s final affairs is about more than just adherence to estate planning documents and the law. Many estate executors, trustees and personal representatives are dealing with complex legal and financial issues while also coping with the loss of someone they care about.

At Grech Legal, we understand that this can be a difficult time for our clients. We strive to make the estate administration and probate process as easy as possible so they can focus on what matters most.

When you work with us, we will advise you on your responsibilities while simultaneously addressing the legal issues associated with these matters so you can be sure your personal interests are protected every step of the way.

Your Responsibilities To Beneficiaries, Heirs And Other Stakeholders

When you are named as an estate executor or trustee, you have the responsibility of managing a deceased person’s assets up through and until they can be distributed to heirs and beneficiaries. Your duties often involve:

  • Collecting records of physical and financial assets of the deceased
  • Paying creditors, taxes and continuing expenses of the estate
  • Notifying government agencies and private organizations that have business with the estate (i.e., credit card companies, the Social Security Administration, the post office, etc.)
  • Determining the proper way to manage the assets of the estate prior to distributing assets to heirs and beneficiaries
  • Distributing assets to heirs and beneficiaries according to the details outlined in the estate planning documents

In the event that an estate planning document, such as a will, is contested, you may have to handle estate issues through legal disputes. You may also need to determine if the probate process is necessary in finalizing the testator/trustor’s affairs.

All of these legal responsibilities can be particularly difficult to manage. Failing to act in the best interest of the individuals who have a claim to the estate can also result in legal troubles. It is always best to consult an experienced lawyer when going through this process.

At Grech Legal, we can help make sure all of the important details are considered through the estate administration and probate process. Let us help you. Arrange a free consultation. We can be reached online or by telephone at 650-549-7728, 408-214-0385 or 510-270-5602.
